Court Delivers Blow to Air Peace, Upholds FCCPC’s Power to Investigate Airfare Complaints

A Federal High Court has dismissed a suit filed by Air Peace Limited seeking to stop the Federal Competition and Consumer Protection Commission (FCCPC) from investigating complaints relating to its airfare pricing and consumer protection issues.

In a landmark judgment, the court affirmed that the FCCPC has the legal authority to investigate consumer complaints across all sectors of the Nigerian economy, including the aviation industry, provided such investigations fall within the provisions of the Federal Competition and Consumer Protection Act.

Air Peace had challenged the commission’s intervention, arguing that the regulation of airline operations and airfare matters falls exclusively within the jurisdiction of the Nigerian Civil Aviation Authority (NCAA). The airline urged the court to restrain the FCCPC from carrying out its investigation.

However, the court rejected the argument, ruling that while the NCAA remains the industry’s primary regulator, the FCCPC is empowered by law to protect consumers from unfair practices, investigate complaints, and promote fair competition, irrespective of the sector involved.

The ruling reinforces the commission’s mandate to safeguard the rights of Nigerian consumers and ensures that businesses operating in regulated industries remain accountable under consumer protection laws.

The dispute stemmed from public complaints over the rising cost of domestic airfares and concerns about airline service delivery. In response, the FCCPC initiated an inquiry aimed at determining whether passengers’ rights had been violated and whether any anti-consumer practices had occurred.

Legal experts described the judgment as a significant milestone for consumer rights in Nigeria, noting that it clarifies the roles of regulatory agencies and affirms that sector-specific regulators and the FCCPC can perform complementary functions within the bounds of their respective laws.

Consumer advocacy groups also welcomed the decision, describing it as a victory for air travellers and a step toward greater transparency and accountability in the aviation industry. They expressed hope that the ruling would encourage improved service delivery and fairer treatment of passengers.
