The Rivers State House of Assembly has alleged that there are attempts to obstruct the ongoing impeachment process against Governor Siminalayi Fubara through the use of restraining orders obtained from courts outside Port Harcourt.
In a statement issued by the Assembly, lawmakers said they received credible information suggesting that certain individuals are approaching courts in judicial divisions outside the state capital to secure ex parte injunctions aimed at stopping the impeachment proceedings. The Assembly stated that such actions are intended to disrupt its constitutional responsibilities and interfere with due legislative process.
The lawmakers argued that impeachment is a constitutional function of the legislature and warned that court orders sought outside the appropriate jurisdiction, particularly those issued without hearing from all parties, would be unconstitutional. They cautioned against the use of the judiciary to interfere with legislative duties.
The Assembly also stated that those affected by the impeachment proceedings should respond to the allegations presented to them, rather than resorting to legal steps meant to delay the process. It added that the Constitution outlines clear procedures for impeachment and does not provide for judicial intervention at that stage.
The lawmakers said the situation has heightened political tension in the state and urged all parties involved to respect the rule of law and adhere strictly to constitutional provisions as the process continues.
